TERMS OF SERVICE

These Terms of Service are entered into between you and Inheart International Limited (Hong Kong company number 77534056), a limited company incorporated in Hong Kong on 31 December 2024, trading as AURASOUL LAB ('AURASOUL LAB', 'we', 'us' or 'our').
OVERVIEW
AURASOUL LAB operates the website at https://www.aurasoullab.com and the related store, content, features, tools, products, digital experiences and services (collectively, the 'Services'). Our online store is hosted by Shopify, which provides the ecommerce platform that enables us to offer the Services to you.
These Terms of Service, together with the policies and notices expressly incorporated by reference, govern your access to and use of the Services and your purchases from us. Please read them carefully. They include important information about orders, natural crystal characteristics, damaged-item claims, customs charges, warranty disclaimers and limitations of liability.
By accessing or using the Services or placing an order, you agree to these Terms and acknowledge our Privacy Policy. If you do not agree, do not use the Services. Nothing in these Terms excludes, restricts or modifies any consumer guarantee, statutory warranty, right, remedy or liability that cannot lawfully be excluded, restricted or modified.
SECTION 1 - ELIGIBILITY, ACCESS AND ACCOUNTS
We do not impose a general minimum age for browsing the Services or using a product. However, you must have the legal capacity required in your place of residence to place an order or enter into these Terms. If you have not reached the age of majority or otherwise lack full legal capacity, you may place an order or use account-based Services only with the consent and supervision of a parent or legal guardian, who agrees to be responsible for your use and purchase to the extent permitted by law.
You may be asked to provide contact, billing, payment and shipping information. You represent that all information you provide is accurate, current and complete and that you are authorized to provide and use it. You are responsible for maintaining the confidentiality of your account credentials and for activity conducted through your account. You may not sell, transfer, assign or license your account to another person.
SECTION 2 - PRODUCTS, NATURAL MATERIALS AND VARIATIONS
We make reasonable efforts to describe and display our products accurately. Images are illustrative unless a listing expressly states that the pictured item is the exact one-of-a-kind piece you will receive. Screen settings, lighting, photography and editing may affect how colors, transparency and surface details appear. Measurements, bead counts and dimensions may vary slightly within reasonable production tolerances.
Crystals, gemstones, shells, wood, pearls and other natural materials are formed by nature and are not visually uniform. Each piece may contain variations in color, tone, saturation, transparency, pattern, matrix, grain, banding, veining, internal inclusions, clouds, feathers, natural fissures, cavities, pits, mineral deposits, surface texture, shape, polish, weight and size. Handcrafted or hand-finished products may also show minor tool marks, assembly differences and bead-to-bead variation. These features (collectively, 'Natural Characteristics') are part of the identity of natural materials and do not, by themselves, constitute damage, a manufacturing defect, misdescription or grounds for compensation, replacement, refund or reshipment.
The Natural Characteristics clause does not apply where an item arrives broken, is materially different from its description, is unsafe, or otherwise fails to conform to a non-excludable requirement of applicable law. Some natural gemstones may undergo accepted enhancement, stabilization or processing methods, including irradiation, resin filling, heat treatment, dyeing, coating or similar methods. A treated or enhanced stone may still be natural in geological origin, but it is not necessarily untreated. Where applicable, known material treatments and any special-care information will be disclosed on the relevant product page or accompanying documentation as required by law.
Product descriptions, availability and specifications may be updated without notice. We may discontinue products or limit quantities by customer, order, region or jurisdiction.
SECTION 3 - SPIRITUAL, WELLNESS AND AI CONTENT
References to energy, frequency, intention, protection, healing, cleansing, manifestation, chakra traditions, crystal meanings or rituals reflect cultural, historical, spiritual or personal-wellness practices. Experiences are subjective, and we do not promise or guarantee any particular physical, emotional, financial, spiritual or other result.
Our products, quizzes, articles, AuraTouch experiences, AI-generated responses and other content are for general informational, reflective and entertainment purposes only. They are not medical, psychological, psychiatric, therapeutic, legal, financial or other professional advice and are not intended to diagnose, treat, cure or prevent any disease or condition. Do not delay or replace advice, diagnosis or treatment from a qualified professional because of the Services. If you may be experiencing an emergency or are at risk of harm, contact local emergency services or an appropriate crisis resource immediately.
AI-generated or personalized content may be incomplete, inaccurate, repetitive or unsuitable for your circumstances. You remain responsible for your choices and should independently verify information before relying on it.
SECTION 4 - ORDERS AND ACCEPTANCE
Placing an order is an offer to purchase. An automated order acknowledgement confirms that we received your request but does not necessarily mean that we accepted it. Unless applicable law requires otherwise, an order is accepted when we send a shipping confirmation or otherwise expressly confirm acceptance. Payment authorization or capture does not by itself require us to accept an order.
We may reject, limit or cancel an order before acceptance for reasons including suspected fraud, payment or pricing error, stock unavailability, duplicate orders, shipping restrictions, sanctions or export-control requirements, or suspected resale. If we cancel after charging you, we will refund the amount charged for the cancelled items.
Review your order, size, delivery address and personalization carefully before submitting it. We may be unable to change or cancel an accepted order once processing or production begins. Custom, personalized, engraved, limited, one-of-a-kind and made-to-order items may be subject to additional terms and may not be cancellable or returnable except where required by law. Purchases are for personal or household use and not for commercial resale unless we agree otherwise in writing.
SECTION 5 - PRICES, PAYMENT, TAXES AND IMPORT CHARGES
Prices, discounts and promotions may change without notice. The price charged is the price displayed at checkout and confirmed in the order record, subject to correction of obvious errors as permitted by law. Prices may differ by market or sales channel. Promotional terms control if they conflict with these Terms for the promotion.
The checkout may calculate, itemize and collect shipping, import duty or customs charges, VAT, GST, sales tax or similar taxes as separate line items. Charges expressly shown in the checkout total are payable to us at checkout, and you authorize us and our payment providers to charge the selected payment method for that total. Unless a charge is expressly shown as included or collected at checkout, displayed product prices exclude shipping, handling, insurance, import duty, tax, brokerage, customs examination, storage, disbursement and other government or carrier charges.
For international orders, duties and taxes itemized and collected at checkout are treated as collected for that order based on the information and rates available at checkout. Customs or tax authorities may reassess a shipment or impose additional brokerage, examination, clearance, storage or other charges. Unless applicable law requires otherwise or the additional amount results from our error, you remain responsible for such additional or uncollected charges and for determining whether the product may lawfully be imported. Where duties or taxes are not collected at checkout, shipment is made on a duties-unpaid basis and you are the importer of record. We do not control or guarantee third-party rates and will not understate value, misdescribe contents or mark a commercial order as a gift.
If you refuse delivery, fail to pay import charges, fail to provide clearance information or do not collect a shipment, the parcel may be returned, abandoned, confiscated or destroyed. To the extent permitted by law, any refund will be reduced by non-refundable shipping, duties, taxes, return charges, brokerage, storage and other costs we incur. No refund is available for a parcel that cannot be recovered, except where mandatory law requires otherwise or the failure resulted from our breach.
SECTION 6 - SHIPPING, DELIVERY, RISK AND CUSTOMS INSPECTION
Processing and delivery dates are estimates, not guarantees. Delays may result from carriers, customs, security screening, weather, labor disruption, peak periods, public-health events, natural disasters, governmental action, inaccurate address information or other events outside our reasonable control. We will provide any remedies required by applicable law.
You are responsible for providing a complete and accurate delivery address and for following tracking and carrier notices. If you authorize delivery to a safe place, parcel locker, building reception, neighbor or another third party, delivery to that location or person may constitute delivery to you to the extent permitted by law. Additional charges caused by an incorrect or incomplete address may be charged to you.
For consumer orders, risk of loss or damage remains with us until you, or a third party designated by you other than the carrier, takes physical possession, except where you independently commission a carrier that we did not offer, in which case risk may pass upon delivery to that carrier. For non-consumer transactions, and otherwise only where permitted by law, title and risk pass when we tender the products to the carrier.
Customs, border, postal, aviation-security and other authorities or carriers may detain, x-ray, open, inspect, sample, rearrange, mark and reseal a parcel. An inspection seal, opened outer packaging, displaced wrapping, additional tape, markings, or disturbance to presentation packaging caused solely by an official inspection does not by itself mean that the product is defective or entitle you to compensation, replacement, refund or reshipment. To the fullest extent permitted by law, we are not responsible for delay, opening, resealing, confiscation or presentation-packaging changes caused by an authority or carrier outside our control, unless the loss resulted from our breach, negligence or legally non-excludable responsibility.
If the product itself is missing, broken or materially damaged after an inspection, follow Section 7. Keep all packaging, labels, inspection notices and seals. We may assist with a carrier or customs claim, but cannot guarantee the decision or timing of a third-party authority.
SECTION 7 - DAMAGED, INCORRECT OR MISSING ITEMS
Inspect the parcel promptly after delivery and before wearing, cleansing, programming, altering or discarding any packaging. For visible transit damage, shortage, tampering or an incorrect item, contact info@aurasoullab.com or support@aurasoul.com within 48 hours after delivery. Include your order number and a clear description of the issue. Latent defects that could not reasonably be discovered on delivery should be reported promptly after discovery. Statutory notice periods and remedies remain unaffected.
To verify a transit claim, we require a continuous, clear and unedited unboxing video beginning before the parcel is opened and showing: the unopened outer parcel from all sides; the shipping label; all seals, tape and any customs or inspection markings; the full opening process; every item and packaging component removed; and close-up views of the alleged damage, shortage or incorrect product. Photographs may be requested as supplementary evidence, but photographs alone do not establish that the product was already damaged before the parcel was opened. You must retain the parcel, internal packaging, tags, product and official notices until the claim is resolved.
If you do not provide the required qualifying unboxing video, we may be unable to verify the condition at delivery and may deny compensation, repair, replacement, refund or reshipment because post-delivery impact, mishandling or other customer-caused damage cannot reasonably be excluded. This evidence requirement does not waive or limit rights that cannot lawfully be waived. Where mandatory applicable law requires us to consider other evidence, we will consider reliable evidence reasonably available to you.
After review, if we confirm that an item arrived broken, materially damaged, missing or incorrect, we will provide the remedy required by law and, where the law allows us to choose, may repair, replace, reship, provide store credit, or refund the affected item and any applicable basic delivery charge. Do not return an item unless we issue written return authorization and instructions.
Except where mandatory law requires otherwise, we do not provide compensation, repair, refund, replacement or reshipment for: Natural Characteristics; differences caused by screen display or reasonable handmade tolerances; personal preference or changed mind outside our Return & Exchange Policy; normal tarnish, plating wear, cord or elastic fatigue; damage after delivery from impact, pulling, compression, water, sweat, chemicals, heat, sunlight, sleep, exercise, improper storage or cleaning; failure to follow care instructions; unauthorized repair, resizing or alteration; or loss after confirmed delivery to you or your authorized recipient or location.
SECTION 8 - RETURNS, EXCHANGES AND REFUNDS
Returns and exchanges are governed by our Return & Exchange Policy at https://www.aurasoullab.com/pages/return-exchange-policy, which is incorporated into these Terms. If there is a conflict, mandatory law controls first; otherwise the more specific Return & Exchange Policy controls for return procedure.
Our voluntary return or exchange period is 30 days after delivery. To qualify, an item must be unworn, unused, unaltered and in its original condition, with all tags, certificates, gifts, accessories and packaging intact. Trying on an item carefully is not use, but wearing, cleansing, programming, resizing, scratching, staining, exposing it to fragrance or chemicals, or otherwise changing its condition may make it ineligible. Prior written authorization is required; unauthorized returns may be rejected or delayed.
To the extent permitted by law, custom-made, made-to-order, personalized, engraved, monogrammed, final-sale, gift-card and hygiene-sensitive items are non-returnable, as are crystals that have been ritually cleansed, programmed or used in a practice after receipt. These exclusions do not apply to goods that are faulty, materially misdescribed or otherwise subject to a non-excludable remedy.
Unless the return results from our confirmed error or applicable law requires otherwise, you are responsible for return shipping, insurance, duties, taxes and customs costs. Original shipping and third-party duties, taxes or brokerage charges are non-refundable to the extent permitted by law. We recommend a trackable, insured service; risk in a customer-arranged return remains with you until we receive it.
We inspect authorized returns before approval. Approved refunds are issued to the original payment method. Processing and bank-posting times are estimates and may vary. We may deduct lawful amounts for diminished value caused by handling beyond what is necessary to inspect the item.
SECTION 9 - PRODUCT CARE, WEAR, ALLERGIES AND SAFETY
Crystal and gemstone jewelry can be fragile. Follow the product-specific care card and website guidance. Unless a product page expressly states otherwise, avoid impact, pulling, compression, prolonged sunlight, extreme heat or temperature change, moisture, swimming, bathing, sleep, exercise, perfume, lotion, cleaning chemicals and ultrasonic or steam cleaning. Some stones and finishes are sensitive to water, salt, acids or common cleansing methods.
Metal composition is stated on the relevant product page. Individual sensitivities vary, and 'hypoallergenic' does not mean allergy-proof. If irritation or discomfort occurs, stop wearing the item and seek appropriate professional advice. Natural stones and small jewelry components may present choking, breakage or ingestion hazards. Keep them away from children and pets and do not ingest, steep or otherwise consume any stone or jewelry component.
Normal tarnish, oxidation, patina, plating wear, surface wear and gradual stretching or fatigue of elastic, thread or cord are affected by use and environment and are not automatically manufacturing defects. Any express warranty and all mandatory consumer rights still apply.
SECTION 10 - AURATOUCH, NFC AND DIGITAL FEATURES
AuraTouch products include an NFC-enabled tap function. The current AuraTouch experience can be accessed by tapping the product with a smartphone that supports NFC reading/tap functionality. The phone's NFC function must be enabled and ordinary device, browser or internet requirements may apply to the linked experience. Compatibility can vary by phone model, settings, operating system and location.
We may maintain, update, modify, suspend or discontinue digital features for security, legal, technical or business reasons. We do not promise uninterrupted or permanent availability, but nothing in this clause allows us to remove paid functionality in a way prohibited by law or inconsistent with an express written commitment made at purchase. Physical damage, unauthorized rewriting, tampering, interference, device settings or third-party changes may affect NFC or linked functionality.
Do not attempt to bypass security, extract confidential code, interfere with other users, or use digital features for unlawful, harmful or abusive purposes. Any additional terms for a linked third-party service will be presented where relevant.
SECTION 11 - INTELLECTUAL PROPERTY
The Services and their content, including AURASOUL LAB names, trademarks, logos, product names, designs, text, images, graphics, video, audio, software, selection and arrangement, are owned by us, our affiliates or licensors and are protected by applicable intellectual-property laws.
We grant you a limited, revocable, non-exclusive, non-transferable right to access and use the Services for personal, non-commercial purposes in accordance with these Terms. Without our prior written permission, you may not reproduce, distribute, modify, create derivative works from, publicly display, publish, scrape, download, store, transmit, sell or commercially exploit any material from the Services, except as permitted by law. No other license or right is granted.
SECTION 12 - OPTIONAL TOOLS AND THIRD-PARTY SERVICES
The Services may provide access to tools, links, content, payment methods, carriers, AI systems or other services operated by third parties. We do not control third-party services and, to the fullest extent permitted by law, provide access to them 'as is' and 'as available' without endorsement. Your use of a third-party service is subject to that provider's terms and privacy practices.
We are not responsible for third-party content, accuracy, availability, security, products or services, except to the extent responsibility cannot lawfully be excluded or the third party acts as our agent in a way for which we are legally responsible. Direct complaints about an independent third-party product or service to that provider, while also notifying us if the issue affects your order.
SECTION 13 - RELATIONSHIP WITH SHOPIFY
AURASOUL LAB is powered by Shopify, which enables us to provide the ecommerce Services. Sales and purchases in our store are made directly between you and us, not Shopify. To the fullest extent permitted by law, Shopify is not responsible for the products sold by us or for injury, damage or loss arising from a transaction between you and us. You release Shopify and its affiliates from claims arising solely from those transactions, except where such release is prohibited by law.
SECTION 14 - PRIVACY
Personal information collected through the Services is handled under our Privacy Policy at https://www.aurasoullab.com/policies/privacy-policy. Shopify also processes information in connection with hosting and providing the ecommerce platform. Review the applicable privacy notices for information about collection, use, disclosure, international transfers and your rights.
SECTION 15 - FEEDBACK, REVIEWS AND USER CONTENT
If you submit ideas, suggestions, reviews, photographs, videos or other content ('Feedback'), you grant us a worldwide, non-exclusive, perpetual, irrevocable, sublicensable, transferable and royalty-free license to use, reproduce, adapt, publish, translate, distribute and display that Feedback in any medium for operating, improving and promoting the Services, subject to applicable privacy and publicity laws.
You represent that you own or control the necessary rights, that your Feedback is accurate to the best of your knowledge, that you disclose any incentive, and that the Feedback does not infringe rights, violate law, contain malware, or impersonate or mislead others. We may moderate or remove Feedback where permitted, but are not required to do so.
SECTION 16 - ERRORS, INACCURACIES AND AVAILABILITY
The Services may occasionally contain typographical errors, inaccuracies or omissions relating to descriptions, pricing, promotions, shipping charges, delivery times or availability. We may correct information, update the Services, or cancel an affected order as permitted by law. If we cancel an order after payment, we will refund the amount charged for the cancelled item.
SECTION 17 - PROHIBITED USES
You may use the Services only for lawful purposes. You must not use them to violate law or rights; commit fraud; submit false information; harass or harm others; transmit malware; send spam; impersonate another person; collect personal information without authorization; scrape or crawl in violation of law or technical restrictions; reproduce or resell the Services; interfere with security or operation; bypass access controls; reverse engineer protected technology except where law permits; or engage in conduct that could damage us, Shopify, our providers or other users.
SECTION 18 - SUSPENSION AND TERMINATION
We may suspend or terminate access where we reasonably believe you violated these Terms, created legal or security risk, engaged in fraud or abuse, or where suspension is required by law. Where appropriate and legally required, we will provide notice and an opportunity to address the issue. Termination does not affect accrued payment obligations or provisions that by their nature survive, including intellectual property, Feedback licenses, disclaimers, liability limits, indemnity, governing law and dispute provisions.
SECTION 19 - DISCLAIMER OF WARRANTIES AND STATUTORY RIGHTS
Nothing in these Terms excludes or limits any guarantee, warranty, condition, right or remedy that cannot lawfully be excluded or limited, including rights relating to title, correspondence with description, satisfactory or merchantable quality, fitness for a disclosed purpose, product safety and delivery.
Subject to the preceding sentence and to the fullest extent permitted by law, the website, informational content, optional tools, AI output and digital Services are provided 'as is' and 'as available'. We disclaim implied warranties or conditions of merchantability, fitness for a particular purpose, durability, title, non-infringement, accuracy, availability and uninterrupted or error-free operation to the extent those warranties may lawfully be disclaimed. Product remedies are governed by applicable law, any express written warranty and our Return & Exchange Policy.
SECTION 20 - LIMITATION OF LIABILITY
Nothing in these Terms limits liability that cannot lawfully be limited, including, where applicable, liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, willful misconduct, gross negligence, breach of non-excludable consumer rights, or any other liability that applicable law prohibits us from limiting.
To the fullest extent permitted by law, neither AURASOUL LAB nor our affiliates, directors, officers, employees, agents, contractors, service providers or licensors will be liable for indirect, incidental, special, exemplary, punitive or consequential loss, or for lost profits, revenue, savings, data, goodwill or business opportunity, arising from the Services or products, even if advised that such loss was possible.
Where liability may lawfully be limited but not excluded, our aggregate liability arising from an affected order or event will not exceed the amount you paid us for the affected product or Service. This limitation does not reduce any minimum remedy or damages available under mandatory law.
SECTION 21 - INDEMNIFICATION
To the extent permitted by law, you agree to indemnify and hold harmless AURASOUL LAB and our affiliates, officers, directors, employees and service providers from third-party claims, losses and reasonable legal costs arising directly from your unlawful misuse of the Services, your infringement of another person's rights, or your material breach of these Terms. This clause does not require you to indemnify us for our own negligence, breach, unlawful conduct or non-excludable liability. We will give reasonable notice of an indemnified claim and allow reasonable participation in its defense.
SECTION 22 - FORCE MAJEURE
We are not responsible for delay or failure caused by events beyond our reasonable control, including natural disaster, severe weather, epidemic, pandemic, war, terrorism, civil disorder, government action, sanctions, customs restriction, labor dispute, carrier interruption, utility or network failure, cyberattack, or supplier failure caused by such events. This clause does not excuse payment already due, remove mandatory consumer remedies, or apply where reasonable mitigation could have prevented the failure.
SECTION 23 - SEVERABILITY
If a provision of these Terms is held unlawful, void or unenforceable, it will be enforced to the maximum extent permitted or modified to the minimum extent necessary, and the remaining provisions will continue in effect.
SECTION 24 - WAIVER AND ENTIRE AGREEMENT
A failure or delay in exercising a right is not a waiver. These Terms and incorporated policies constitute the entire agreement between you and us regarding the Services and supersede prior communications on the same subject, except for express product descriptions, order confirmations and written warranties that form part of your purchase. Nothing in this clause excludes liability for fraud or misleading statements where exclusion is prohibited.
SECTION 25 - ASSIGNMENT
You may not assign or transfer these Terms without our prior written consent. We may assign or transfer our rights and obligations in connection with a merger, reorganization, sale of business or similar transaction, provided that the transfer does not reduce non-excludable consumer rights. We will give notice where required by law.
SECTION 26 - GOVERNING LAW AND DISPUTES
These Terms and any non-contractual obligations arising from them are governed by the laws of the Hong Kong Special Administrative Region, without regard to conflict-of-law rules. The courts of Hong Kong SAR have non-exclusive jurisdiction. If you are a consumer, this choice does not deprive you of mandatory protections or the right to bring proceedings in another forum available to you under the law of your habitual residence. Before filing a claim, please contact us and allow a reasonable opportunity to resolve the issue informally.
If these Terms are translated, the English version controls to the extent permitted by law, but this does not limit rights arising from a legally required local-language version.
SECTION 27 - CHANGES TO THESE TERMS
The current version is posted on this page. We may update these Terms for legal, security, technical or business reasons. Material changes will be notified as required by law and will apply from the stated effective date. Changes do not retroactively alter an accepted order unless permitted by law or agreed by you. Continued use of the Services after an effective update constitutes acceptance only to the extent permitted by law.
